الملخص

استرعت في الآونة الاخيرة ظاهرة المهاجرين العالقين على الحدود الدولية الأنتباه و تم التسليط الضوء على محنهم و مأساتهم الأنسانية التي تعود اسبابها عدم تبلور نظام قانوني متكامل الابعاد ينطبق على هذه الفئة من المهاجرين بغية الحيلولة دون الأمعان في استغلال مآسيهم و اوضاعم القانونية الهشة بحجج و مسوغات واهية كان من لامفروض أن لا تكون استخدام حياة الأنسان بحجة انهم مهاجرين غير شرعيين و غير طبيعيين في لعبة السياسة و عمليات توفير الأمن و حراسة الحدود الدولية. لذلك ارتأينا ان نتناول في هذا البحث المركز القانوني لهذه الفئة من المهاجرين، و أن نطرح ألابعاد القانونية، أو بالأحرى الثغرات التي تعتري أوضاعهم القانونية، مما يحرمهم من اللجوء الى التوسل بالوسائل القانونية اللازمة و يعرضهم الى اوضاع حاطة بأنسانيتهم و كرامتهم لا تقبلها ألضمير الانساني و تأبها مبادئ العدالة و الأنصاف. و من تبعات هذا الوضع القانوني الهش تم التضحية بهولاء المهاجرين لتأمين حدود الدول، حتي أن الدول التي اضطرت الى التعامل مع هذه الفئة من المهاجرين تصورت الأمر على أنه يتعلق بفشلها على تأمين حدودها و ليس عدم أمكانيتها في توفير الحماية القانونية اللازمة لهم.
