الملخص

تعد الحملات الانتخابية أحد مراحل العملية الانتخابية وهي تعني مجموع الفعاليات والأنشطة التي يقوم بها المرشح أو الحزب السياسي ضمن فترة زمنية وعادة ما تكون سابقة لميعاد الإقتراع بيوم واحد أو أكثر حسب التشريعات يكون الهدف من هذه الفعالية إثارة وجدان الرأي العام واستقطاب آراء الناخبين ودفعهم بوسائل الإعلام المختلفة للتصويت عن هذا المرشح أو ذلك الحزب، وتكون هذه العملية مؤثرة في نتائج الإنتخابات سواء كانت نيابية أو رئاسية لأنها تستهدف الأصوات التي توصل المرشح أو الحزب السياسي إلى دفة رئاسة الدولة أو السلطة التشريعية وحتى لا يساء إستخدام هذا الحق في الترويج للأفكار والرؤى السياسية باعتبار ذلك أحد فروع حرية الرأي والتعبير التي كفلتها معظم الدساتير ولضمان حرية ونزاهة وعدالة الانتخابات، نجد أن القانون العراقي وكذلك القوانين المقارنة أخضعت مباشرة هذه العملية لبعض القيود والمحددات، هذه الدراسة تركز الضوء على الحملة الانتخابية وطبيعتها وأسسها وأهدافها والقيود القانونية التي تباشر في حدودها سواء كانت زمانية أم مكانية أو مالية وغيرها من القيود التنظيمية بهدف الوقوف على مواطن القصور في بعض التشريعات واقتراح الحلول لمعالجتها.
