الترخيص الإجباري لاستغلال براءة الاختراع بين الاستئثار والتقييد وفقاً لأحكام القانون الإماراتي

الملخص

أن براءة الاختراع تعني منح المخترع حق من حقوق الملكية الفكرية التي يستأثر به مالك البراءة دون غيره. والترخيص الإجباري يسمح للحكومة أو القضاء استغلال عن طريق استخدام أو تصنيع السلع والصناعات المحمية ببراءة اختراع إلى طرف ثالث دون موافقة مالك البراءة. وقد أشار إلى هذه الوسيلة مرسوم بقانون رقم 11 لسنة 2021 في شأن تنظيم وحماية حقوق الملكية الصناعية، إلا أن المشرع الإماراتي جعل اللجوء إلى هذه الوسيلة على سبيل الاستثناء، إذ قّيد هذه الوسيلة بمبررات تقتضيها المصلحة العامة للمجتمع.

ستركز الدراسة على وصف ماهية الترخيص الإجباري ومبرراته. ثم بيان الأحكام الناظمة للترخيص الإجباري وبيان فلسفة المشرع الإماراتي من خلال تحليل نصوص، وبيان مدى نجاعة المشرع في التوازن بين مصلحة المجتمع ومصالح المخترعين.

 ولعل من أهم التوصيات التي توصل إليها الباحث: دعوة المشرع الإماراتي إلى تحديد المدة التي يمكن من خلالها الحكم على المرخص له بإيجابية، لمثل هذا الاستغلال وتحقيقه الحدود القصوى من المنافع، لاسيما في نطاق اشباع حاجة المستهلك.
