دراسة حالة على الانتخابات البرلمانية في مملكة البحرين

الملخص

الانتخابات هي أحد دعامات الديمقراطية، عليه لابد أن تتوافر الضمانات القانونية الوافية لصون الديمقراطية ومن أهم أوجه ذلك توفير قواعد خاصة تحكم الدعاية الانتخابية لما لها من بالغ التأثير على خيار الفئة الناخبة وبالتالي تشكيل المجلس النيابي والتشريعات وسياسة الدولة لعدد من السنوات.  بالتالي فهذه الدراسة تركز على ما قد يضلل الناخبين ويؤثر في اختياراتهم من سلوك المرشحين من ضمن ذلك ما يمكن تصنيفه كوعد انتخابي سواء كان بشكل مباشر أو غير مباشر، بالتركيز على بحث حدود الوعود الانتخابية ومدى إلزاميتها بهدف تحقيق الحماية الجنائية لفئة الناخبين. ستعتمد هذه الدراسة المنهج الوصفي التحليلي لعرض فروضها ببحث التشريع البحريني والتشريع والقضاء المقارن.

وقد توصلت الدراسة إلى محاولة رسم الحدود الموضوعية للوعود الانتخابية وتصرفات النائب المنتخب التي قد تعد تضليلا وتكسباً سياسياً يؤثر في العملية الديمقراطية، وانتهت الدراسة باقتراح مواد وتعديلات قانونية توفر الحماية الجنائية من التضليل الذي قد يقع فيه الناخبين بمملكة البحرين.
