الملخص

ان الطبيعة الخاصة التي تتمتع بها قواعد القانون الاداري المتمثلة بالظروف التاريخية لنشأتها وتعدد مجالات النشاط الاداري واتسامه بانه قانون سريع التطور يفوق التطور الاعتيادي في القوانين الاخرى لا سيما قوانين الوظيفة العامة بسبب تطور نشاط الادارة كان لابد ان ينعكس على القوانين التي تحكم العلاقة بين الموظف والدولة ومنها قانون انضباط موظفي الدولة والقطاع العام رقم (14) لسنة 1991 المعدل بالقانون رقم (5) لسنة 2008 ، وان تعديله عام 2008 بإدخال بعض التعديلات البسيطة لا ترقى الى مستوى تطور نشاط الادارة واتجاه المشرع الدستوري وفقا لدستور العراق لعام 2005 ، اضافة الى ان القواعد القانونية ذات الصلة بانضباط الموظفين يشوبها النقص حتما باعتبارها عملا انسانيا لا يتصف بالكمال وبما تحمله من عمومية لاسيما ما يخص اجراءات وضمانات التحقيق الاداري والمخالفات الانضباطية فتح ذلك الباب لدور تطويري يقوم به مجلس الدولة .
