الملخص

 يعد فسخ عقد البيع الدولي أحد الحلول التي يلجأ إليها الطرفان والقانون لحل بعض المخالفات الجوهرية التي تطرأ على العقد لأي سبب من الأسباب ولكن تحديد السبب الجوهري الذي يؤدي لفسخ العقد هو أقصى أنواع معالجة المخالفة الجوهرية التي اختلف في تفسيرها من قبل الخبراء الدوليين سواء ً كانت محاكم دولية أو هيئات ولجان تحكيم دولية. ونسبة لصعوبة تحديد المخالفة الجوهرية التي تؤدي لفسخ العقد والاستثناءات الواردة بخصوص الحالات التي تُعد مخالفة جوهرية والتي لا تُعد مخالفة جوهرية فتتبع البحث الحالات التي تُعد مخالفة جوهرية والتي لا تُعد مخالفة للعقد من وجهة نظر المحاكم وهيئات التحكيم الدولية، وتوصل البحث إلى أن ما من مخالفة جوهرية للعقد إلاّ ولها استثناء من وجهة نظر أخرى لا تعد مخالفة جوهرية وهذا لا يؤدي لعدم استقرار الأحكام التي توصلت إليها المحاكم وهيئات التحكيم الدولية بل يساعد في التوصل لسد الثغرات التي بالتشريعات أو بالعقود التي تتم بين الأشخاص أو بين الدول.
