The Crime of Genocide within the Framework of Artificial Intelligence Technologies Case Study: The Yazidis

Abstract

Genocide is one of the most serious crimes that threaten the natural human right to life, which is established by constitutions and international agreements. The domestic legislature seeks to protect all rights for all segments of the population, especially minorities, with laws that are consistent with the state's general constitution and do not violate international agreements. This type of crime, despite its antiquity, has seen its perpetrators develop the tools to commit it, including artificial intelligence technologies, which have become an important role in committing various crimes. This is done through the use and analysis of data, then identifying the targets against whom the crime should be committed, namely a specific group of people. This is done through intelligent machines with absolute effectiveness in targeting human groups—the Yazidis—the subject of the crime. Therefore, the use of artificial intelligence technologies in committing this crime has prompted the legislature to determine how to confront it legally, in order to document the genocide of the Yazidi component by criminalizing specific behaviors that have already occurred and which it is reasonable to assume were committed using artificial intelligence systems. Through this research, we seek to clarify the nature of the crime of genocide against the Yazidi component through artificial intelligence. We also clarify its elements, the most important means used in it, in addition to clarifying and defining the scope of criminal responsibility of its perpetrators, and clarifying the most important penalties and compensations stipulated by the legislator. The study aims to reach legal conclusions in order to confront this crime and combat its effects, by confronting intellectual extremism and the crimes that result from it that affect the security of humanity, as well as proving its occurrence. In this research, we use the analytical method, in order to analyze the crime of genocide from all its elements, and seek to clarify the scope of international criminal responsibility and the consequences thereof, and the descriptive method to clarify the agreements formulated by the international community to protect against all behaviors that result in the occurrence of the crime, and the extent of their adequacy in combating the crime of genocide.
