الملخص

 "یحتل الدستور المرتبة العلیا في التدرج التشریعي، إذ تعد قواعده أسمى القواعد في النظام القانوني كله، وتبعا لذلك یترتب على السلطة المختصة في التشریع أن تحترم الدستور وأن لا تخالفه، وبمعنى أخر ینبغي أن یكون التشریع الذي یصدر عنها دستوریا أي موافقا للدستور شكلا وموضوعا، وقد نظمت الوثائق الدستورية الحديثة في العديد من الدول مسألة إيجاد رقابة على عمل تلك السلطات, وهذه الرقابة قد تكون قضائیة وذلك حینما تمارس من قبل القضاء، وقد تكون غير قضائية حينما يعهد بها إلى هیئات أخرى، وتتحقق الرقابة القضائیة عن طریق دعوى أصلیة ترفع للطعن في قانون أو لائحة أمام محكمة دستوریة علیا، أو عن طریق الإحالة من خلال قضاء الموضوع حینما تثار دستوریة تشریع قانون أو لائحة بمناسبة قضیة معروضة أمام محكمة الموضوع، كما یمكن لها أن تتحقق عن طریق الجمع بین الدعوى الأصلیة والدفع الفرعي, علما بأن الرقابة القضائیة على دستوریة التشریعات هي أفضل طرق الرقابة نظرا لما یتسم به القضاء من حیاد واستقلال بالإضافة إلى ابتعاده عن الأهواء والنزوات. "
